Legal action

  • Eviction proceedings –Where nuisance or ASB is affecting the locality RHT can apply to the County Court for an order for possession, which could lead to eviction.
  • Injunctions An injunction can be applied for as part of a possession order or an Anti Social Behaviour Order where there is risk of violence to other people.
  • Anti-Social Behaviour Order (ASBO) –this excludes a person from a specified area for a minimum of 2 years. They can be made against anyone who is 10 years old or above, and who has acted in a manner that caused or was likely to cause harassment, alarm or distress to one or more persons not of the same household as himself. RHT would apply for this in consultation with the Torbay ASB Task Force.
  • Where ASBO's are obtained against children aged 10-17 parenting orders may also be applied to the parents or legal guardians of these children.

Non-legal action

  • Mediation – can be used as an effective tool to resolving disputes where there are cross tenure issues or between RHT tenants agree a way forward. Solutions are not imposed, but agreed by both sides. Mediation is carried out by an independent service.
  • Acceptable Behaviour Contracts (ABC)– An ABC simply sets out agreed items that the offender agrees to or not to do in specified areas. ABC's will be issued only after liaison with the ASB Co-ordinator to ensure consistency between agencies.
